El 1 de diciembre de 2026 entra en vigencia la Ley 21.719 y todos los que tienen un sitio web en Chile van a buscar a alguien que los deje en regla. El problema es que casi nadie puede hacerlo completo — y eso es justamente lo que casi nadie te dice antes de cobrarte.

On December 1, 2026, Chile's Law 21.719 comes into force and everyone with a website will look for someone to get them compliant. The problem is that almost nobody can do the whole job — and that's exactly what nobody tells you before invoicing.

El problema de contratar solo a un abogado

Un buen estudio jurídico te va a redactar una política de privacidad impecable y explicarte qué exige la ley. Todo correcto. Pero un abogado no entra a tu sitio a bloquear los scripts de seguimiento, no revisa si el archivo donde se guardan tus reservas quedó accesible desde el navegador, y no configura el aviso de cookies para que no cargue nada antes de que el visitante acepte.

A good law firm will draft you an impeccable privacy policy and explain what the law requires. All correct. But a lawyer doesn't go into your site to block tracking scripts, doesn't check whether the file holding your bookings is reachable from a browser, and doesn't configure the cookie notice so nothing loads before the visitor accepts.

Te queda un documento perfecto describiendo un sitio que sigue haciendo exactamente lo que hacía antes. En una fiscalización eso es peor que no tener nada: la política declara una cosa y el sitio hace otra.

You end up with a perfect document describing a site that still does exactly what it did before. Under scrutiny that's worse than having nothing: the policy states one thing and the site does another.

El desarrollador te instala un plugin de cookies, te pega un texto de política sacado de un generador gratis y te dice que ya está. Rápido y barato. Pero nadie verificó si ese texto describe lo que tu negocio realmente hace con los datos, ni si las bases legales que invoca son las correctas para tu caso.

The developer installs a cookie plugin, pastes in policy text from a free generator, and tells you you're done. Fast and cheap. But nobody checked whether that text describes what your business actually does with data, or whether the legal bases it invokes are the right ones for your case.

Y si algo sale mal, la agencia no responde por eso. No es su rubro y no tiene responsabilidad profesional en materia legal.

And if something goes wrong, the agency doesn't answer for it. It's not their field and they carry no professional liability on legal matters.

Hay tres cosas que aparecen una y otra vez, y las tres son invisibles desde afuera — el sitio se ve perfecto mientras tanto:

• Scripts de seguimiento que cargan antes de que el visitante acepte nada
• Archivos con datos de clientes que se abren escribiendo la URL directa
• Claves de sistemas de pago visibles en el código que llega al navegador

• Tracking scripts loading before the visitor accepts anything
• Files with customer data that open by typing the direct URL
• Payment system keys visible in the code sent to the browser

Lo decimos con conocimiento propio: encontramos varias de estas fallas en nuestro sitio y las cerramos antes de escribir esto. Una agencia que nunca ha encontrado una falla es una agencia que no ha buscado.

We say this from our own experience: we found several of these on our own site and closed them before writing this. An agency that has never found a flaw is an agency that hasn't looked.

How much time is actually left

Si eres pyme, entre diciembre de 2026 y diciembre de 2027 la primera sanción es una amonestación, no una multa. Es un colchón, pero no es una excusa para llegar sin nada: la amonestación llega igual y te da un plazo para corregir, con el reloj corriendo.

If you're a small business, between December 2026 and December 2027 the first sanction is a warning, not a fine. That's a cushion, but not an excuse to show up with nothing: the warning still arrives and gives you a deadline to fix things, with the clock running.

Si eres una empresa grande, no tienes ese colchón. Las multas aplican desde el primer día, y llegan hasta 20.000 UTM o el 4% de tus ingresos anuales.

If you're a large company, you don't get that cushion. Fines apply from day one, up to 20,000 UTM or 4% of your annual revenue.
